HOW CAN YOU LOOK AFTER DAVID AND BETH?

In preparation for their long-anticipated Mediterranean summer holiday, David and Beth arranged for some essential repairs to be carried out on their 10.5-metre single hull yacht over the winter at a local boat yard.

Having set sail from the boat yard they set off across the English Channel. Midway through the crossing, the engine suddenly failed, and they had no alternative but to return to the marine yard.

On inspection, it was found that the repair work had not been completed to a satisfactory standard. Critical components were incorrectly installed, leading to the engine failure. The yacht required significant further work, and the repair timeline meant the boat would not be seaworthy for some time, meaning David’s and Beth’s holiday plans were in tatters.

Frustrated and facing financial loss—not only for the faulty repairs but also for the cancellation of their planned trip—they need to get some advice on what they could do to obtain compensation from the marine technician who did the original work.

WAYPOINT

David and Beth saw how quickly a routine repair escalated into a serious disruption and dispute. Without specialist marine legal expenses insurance, they are likely to face expensive legal bills to recover their financial losses.

Addept Insurance’s Waypoint policy includes contract dispute cover to provide boat owners with peace of mind and protection in the event of such issues occurring. David and Beth could speak to a specialist solicitor who would provide advice on the next steps and help to proceed a claim to recover damages from the technician, including compensation for faulty repairs and partial reimbursement for their lost holiday costs against the marine technician for breach of contract removing the stress from an already difficult situation.

  • Legal costs for specialist marine lawyers to recover uninsured losses and pursue claims for personal injury because of a collision, impact, fire, or flooding up to £100,000.

  • Up to £25,000 or £50,000 for the costs to defend or pursue breach of contract.

  • Loss of Mooring Fees or temporary vessel replacement costs.

  • Emergency Expenses relating to a vessel damaged overseas following a collision, impact, fire, or flooding.

  • 24/7 specialist marine and non-marine legal, and health and medical information helplines.

  • Cover for legal costs relating to defend prosecutions and the impact of identity fraud.
